US Supreme Court Rules in Favor of Lawsuits over Retaliation

In a strong victory for civil rights and employment rights activists, two US Supreme Court rulings Tuesday established that laws barring discriminatory behavior at work also allow employees to sue their employers for retaliation, even if the right is not explicitly stated in the statute. The Court’s decisions in CBOCS West v. Humphries and Gomez-Perez v. Potter continue a recent Court trend towards embracing expansive interpretations of civil rights statutes.

Retaliation is the act of punishing or penalizing an employee who complains about discriminatory behavior or conduct in the workplace; employers often seek to silence complaining employees for fear that such bad publicity will hurt profits.
